1) نطاق التطبيق والأطراف والتعاريف

1.1 تسري هذه الشروط على العقود المبرمة بين Ypsilon.dev UG وبين العملاء في مجال الاستضافة والنطاقات.

1.2 يُقصد بالعميل رائد الأعمال أو المؤسسة التي تبرم العقد في إطار نشاطها المهني.

1.3 لا تسري شروط العميل إلا بعد موافقة كتابية من Ypsilon.dev.

1.4 تنطبق هذه الشروط على كل التعاملات المستقبلية ما لم يُتفق خلاف ذلك كتابةً.

2) العروض وإبرام العقد

2.1 العروض المقدمة من Ypsilon.dev غير ملزمة وتكون صالحة لمدة 30 يومًا من تاريخ العرض ما لم يُذكر خلاف ذلك.

2.2 ينعقد العقد بعد تأكيد الطلب من Ypsilon.dev أو تنفيذ الخدمة المطلوبة.

2.3 في حالة تسجيل النطاقات، يصبح العقد نافذًا عند تسجيل النطاق بنجاح لدى الهيئة المختصة.

3) نطاق الخدمة

3.1 تشمل خدمات Ypsilon.dev توفير استضافة مواقع إلكترونية وإدارة أسماء نطاقات وفق الشروط المتفق عليها.

3.2 لا تقدم الشركة أي ضمانات قانونية بشأن محتوى العميل أو توافقه مع القوانين المحلية.

4) التزامات العميل

  • 4.1 تقديم بيانات صحيحة ومحدثة.
  • 4.2 الالتزام بالتعاون الفني وتزويد المعلومات اللازمة لتفعيل الخدمات.
  • 4.3 العميل مسؤول عن جميع المحتويات المنشورة أو المستضافة لديه قانونيًا.
  • 4.4 يجب على العميل حفظ نسخة احتياطية من بياناته بشكل دوري.

5) الاستضافة

5.1 تضمن Ypsilon.dev معدل توافر سنوي لا يقل عن 98%، مع استثناء الأعطال الناتجة عن قوة قاهرة أو صيانة ضرورية.

5.2 قد يتم تقييد الوصول إلى الخوادم مؤقتًا لضمان سلامة النظام.

5.3 النسخ الاحتياطي مسؤولية العميل ما لم يُنص على خلاف ذلك.

6) أسماء النطاقات (الدومينات)

6.1 تعمل Ypsilon.dev كوسيط لتسجيل النطاقات ولا تضمن قبول أو استمرار تسجيل النطاق من قبل الجهة المنظمة.

6.2 العميل يضمن أن النطاق المطلوب لا ينتهك حقوق الغير.

6.3 يجوز للشركة تعليق الخدمة في حالة وجود شكوى قانونية مرتبطة بالنطاق.

7) الأسعار والدفع

  • 7.1 تستحق الفواتير عند تفعيل الخدمة أو التسليم.
  • 7.2 فترة السداد 15 يومًا من تاريخ الفاتورة.
  • 7.3 الأسعار بالدولار الأمريكي.
  • 7.4 للشركة الحق في تعليق الخدمة عند تأخر الدفع.

8) حقوق الاستخدام

8.1 تنتقل حقوق الاستخدام بعد سداد كامل المستحقات.

8.2 يحق للعميل استخدام الخدمات في حدود الاتفاق فقط، ولا يجوز نقل الحقوق أو إعادة ترخيصها.

9) المسؤولية

9.1 تقتصر مسؤولية Ypsilon.dev على الإهمال الجسيم أو المتعمد فقط.

9.2 لا تتحمل الشركة مسؤولية فقد البيانات أو الأضرار غير المباشرة أو خسارة الأرباح.

9.3 العميل مسؤول عن النسخ الاحتياطي الدوري لبياناته.

10) الخصوصية والسرية

10.1 تلتزم الأطراف بالحفاظ على سرية البيانات المتبادلة وعدم مشاركتها مع أطراف خارجية.

10.2 تظل السرية قائمة حتى بعد انتهاء العقد.

11) البريد الإلكتروني

11.1 لا يجوز استخدام البريد الإلكتروني كمخزن للملفات.

11.2 يُمنع إرسال رسائل تسويقية غير مرغوبة، ويحق للشركة تعليق الخدمة في حال المخالفة.

12) المدة والإنهاء

12.1 مدة العقد 12 شهرًا وتجدد تلقائيًا ما لم يتم الإنهاء قبل 4 أسابيع من انتهاء المدة.

1) Scope, Parties, and Definitions

1.1 These terms apply to all contracts concluded between Ypsilon.dev UG and clients regarding hosting and domain services.

1.2 The term “client” refers to any business or professional entity entering into the contract in the course of its commercial activity.

1.3 Client’s terms or conditions shall not apply unless expressly approved in writing by Ypsilon.dev.

1.4 These terms also apply to all future business dealings unless otherwise agreed in writing.

2) Offers and Contract Formation

2.1 Offers from Ypsilon.dev are non-binding and valid for 30 days from the date of issue unless otherwise stated.

2.2 The contract is concluded once Ypsilon.dev confirms the order or provides the requested service.

2.3 In the case of domain registration, the contract becomes effective upon successful registration with the relevant authority.

3) Scope of Service

3.1 Ypsilon.dev provides web hosting and domain management services in accordance with the agreed terms.

3.2 The company does not provide legal guarantees regarding client content or its compliance with applicable laws.

4) Client Obligations

  • 4.1 Provide accurate and up-to-date information.
  • 4.2 Cooperate technically and provide the necessary information to activate services.
  • 4.3 The client is fully responsible for all hosted or published content.
  • 4.4 The client must regularly back up their data.

5) Hosting

5.1 Ypsilon.dev guarantees an annual uptime rate of at least 98%, excluding downtime due to force majeure or required maintenance.

5.2 Access to servers may be temporarily restricted to maintain system integrity.

5.3 Data backups are the client’s responsibility unless otherwise agreed in writing.

6) Domain Names

6.1 Ypsilon.dev acts as an intermediary for domain registration and does not guarantee acceptance or continued registration by the relevant registry.

6.2 The client guarantees that the requested domain does not infringe upon the rights of third parties.

6.3 The company may suspend services if a legal dispute arises related to the domain.

7) Prices and Payments

  • 7.1 Invoices are due upon activation or delivery of the service.
  • 7.2 Payment must be made within 15 days of the invoice date.
  • 7.3 Prices are in USD.
  • 7.4 The company reserves the right to suspend service in case of late payment.

8) Usage Rights

8.1 Usage rights are transferred only after full payment of all dues.

8.2 The client may use the services only within the agreed scope and may not transfer or sublicense the rights.

9) Liability

9.1 Ypsilon.dev is liable only for intent or gross negligence.

9.2 The company is not liable for data loss, indirect damages, or loss of profits.

9.3 The client is responsible for regular data backups.

10) Privacy and Confidentiality

10.1 Both parties agree to keep exchanged data confidential and not to disclose it to third parties.

10.2 Confidentiality remains in effect even after the termination of the contract.

11) Email Usage

11.1 Email accounts may not be used as file storage.

11.2 Sending unsolicited marketing messages (spam) is prohibited, and the company may suspend the service in case of violation.

12) Duration and Termination

12.1 The contract duration is 12 months and renews automatically unless terminated at least four weeks before expiration.
